This advisory is to inform you of recent regulatory changes announced by U.S. Customs and Border Protection (CBP) regarding Section 232 tariffs. Effective August 18, 2025, additional steel and aluminum derivative products have been added to the Harmonized Tariff Schedule of the United States (HTSUS) under Presidential Proclamations 10896 (Steel) and 10895 (Aluminum).
Expansion of Section 232 Steel & Aluminum Tariffs
On Friday, August 15th (After business hours) the U.S. Commerce Department expanded the scope of Section 232 tariffs by adding 407 new HTSUS codes covering steel and aluminum products (see Annex I). Per the Federal Register notice, the steel and aluminum items remain subject to the standard Section 232 tariff rate, while other items listed will face the applicable reciprocal tariff rate. These changes apply to goods entered for consumption, or withdrawn from warehouse for consumption, starting at 12:01 a.m. Eastern Time on August 18, 2025.
Key Points:
- Additional HTSUS Codes Added: New steel and aluminum derivative products are now subject to Section 232 duties.
- Duty Rates: Steel: 25%–50% ad valorem (country/product specific)
- Aluminum: 25%–50% ad valorem (country/product specific)
- Certain U.S.-origin processed products may qualify for 0% duty under designated Chapter 99 provisions.
Reporting Requirements:
- Importers must report country of melt/pour for steel products.
- Importers must report primary/secondary smelt and cast country for aluminum products. Incomplete reporting may trigger higher Russia-related duties.
Foreign Trade Zones (FTZ): Goods must be admitted under “privileged foreign status” if entered after August 18, 2025.
Drawback: No drawback is permitted for duties imposed under these proclamations.
